Under the leadership of former MP Shri Gopal Shetty, the BJP OC Study Group held an important meeting with Guardian Minister Shri Ashish Shelar regarding the proposed Amnesty Scheme. Present in the meeting Shri Arvind Nandapurkar, Shri Tarun Motta, Adv J P Mishra, Adv Ameet Mehta, Adv Vivekanand Gupta and Adv Siddharth Sharma.
During the meeting, detailed suggestions were put forth by the BJP OC Study Group to ensure that the Amnesty Scheme provides genuine relief to housing societies and residents while safeguarding planning norms.
Key Suggestions from BJP OC Study Group:
• No Change in Building Line and Height: The building line and height as per the original Commencement Certificate (CC) should remain unchanged.
• Density & Open Spaces: There should be no increase in the density of tenements and no reduction in open spaces.
• Parking Protection: Parking areas must not be covered under regularisation.
• Part OC & Deemed OC: Provision should be made for granting Part Occupation Certificate (Part OC) and the concept of Deemed OC should be recognised.
• Charges on FSI: Fees should be charged only for the difference above the approved FSI. Free of FSI areas should not attract charges during regularisation.
• Penalty Structure:
• Zero penalty for compliance within six months of Amnesty Scheme implementation (till 31st March, 2026).
• 50% penalty for compliance beyond six months (till 31st October, 2026).
• Strict Action on RG & Setback: Recreational ground (RG) encroachments and setback violations must be removed aggressively.
• Delinking of Unauthorised Units: Unauthorised works in a few units should be delinked, allowing Part OC for the rest of the building.
• Scope: The scheme should be applicable to all buildings except RERA-registered projects.
After listening to the Suggestions Shri Assem Gupta, Principal Secretary of Urban Development took note of all suggestions and assured positively to incorporate all this points in Amnesty Scheme to be formulated on the suggestion of BJP OC Study Group.
Speaking on the occasion, Shri Gopal Shetty stated,
“The BJP OC Study Group has consistently stood with the citizens of Mumbai who are facing difficulties due to lack of Occupation Certificates. We have suggested practical and citizen-friendly measures for the Amnesty Scheme, and we are confident that under the leadership of Shri Devendra Fadnavisji, Guardian Minister Shri Ashish Shelar and Mumbai BJP President Shri Ameet Satamji, these concerns will be addressed positively.”
The BJP OC Study Group reaffirmed its commitment to work closely with the government to bring long-awaited relief to thousands of housing societies and residents of Mumbai.
